Jagatsinghpur, 24/01/26 ( Odisha Samachar )-The Government Odisha has issued a modification to the existing Gutka ban through a Gazette Notification dated 21 January 2026, reaffirming its commitment to protecting public health. The notification clarifies and strengthens provisions under the Food Safety and Standards Act, 2006, explicitly prohibiting the manufacture, storage, distribution, sale, and consumption of Gutka and all food products containing tobacco and/or nicotine. The modified gutkha ban will remove ambiguities, ensure legal clarity, and enable uniform implementation across the State. It reiterates that tobacco and nicotine cannot be used as ingredients in any food product and that violations will attract strict penal action under applicable laws.
In the modified gutkha ban order , the manufacturing , processing, packaging , storage , transport, sale of all food products containing tobacco or nicotine as ingredient prohibited in the state of Odisha This prohibition extends to all food products whether chewable or flavoured , mixed , scented and mixed with any additives
The prohibition extended all food products whether going by names or forms of Gurkha , pan masala, flavoured or scented food products or chewable food products by whatever name called
This provision also extends to all food products whether packaged or unpackaged and or sold one products or packaged as separate products sold or distributed in such a manner so that easily facilitate mixing by the consumer and any other food products containing tobacco or nicotine as ingredients.
All enforcement authorities have been directed to ensure strict compliance, reinforcing the Government’s sustained efforts toward tobacco control, cancer prevention, and safeguarding public health, particularly among youth and vulnerable population
The order reinforces that tobacco and nicotine are not permitted as ingredients in any food products, as per food safety regulations. Any violation of this order shall invite strict penal action, including seizure of products, cancellation of licenses, and prosecution as per applicable laws.
All District Collectors, Food Safety Officers, Police Authorities, and other enforcement agencies have been directed to ensure strict compliance with the modified order. Special drives will be conducted to curb illegal sale and circulation of banned products.
The Government appeals to the public, traders, and vendors to cooperate fully with the authorities and support the collective effort to protect public health, especially the health of youth and vulnerable populations. This modification reflects the Government’s continued commitment towards tobacco control, cancer prevention, and promotion of a healthier society..
