5th LEGAL DEPARTMENT CONFERENCE :  NEIGHBOUR FARM LAND OWNER MAY SUE YOU FOR EXCESSIVE USE OF PESTICIDE AND FERTILISER IN YOUR LAND TOO

Bhubanewar ,26/10/2021 ( Odisha Samachar)- The fifth legal conference of legal department of united cow lovers organisation odisha organised the debate on compulsory organic farming and its sustainable development management in Odisha. In the conference number of key factors on the issue were discussed. Besides the organisation’s legal convener Mr.Prasanta Varma, Advocate, Supreme Court of India, head of the institution and social activist Dr. Jagannath Patnaik coordinate and put their valuable lectures too. Dr.Prasanna Kumar Patasani being the guest of honour shown his concern for the people of Odisha and appreciated the proposal for compulsory organic farming in Odisha. He shown his pleasure that people of odisha in many a parts are giving respect to the organic farming barring few districts which were even otherwise affected by massive industrialisation.  “As the chief speaker Dr. Balaram Sahu, convener odisha chapter of Kalam Research Institute, eminenent vetenary scientist and national award winner gave a vivid report district wise in odisha how our people are giving respect to the organic farming. On sustainable development for complete organic farming he lays emphasis on traditional country cow farming. He further give illustration as to how our own species of cows are going extinction. On pricing of the milk, desi ghee he further illustrate various quality of cow milk alike A1, A2 types and prices in market. “The keynote speaker Mr. Biswa Ranjan Paramguru, Advocate, National Green Tribunal said that excessive use of Pesticide, insecticide in agricultural lands become hazardous to the health of farmers and it also directly responsible for the loss of soil fertility, which sometimes turn an agricultural land into a barren land. He referred the matter of Shailesh Singh Vrs. Union of India & Ors, one Public Spirited person filed an Original Application before Principal Bench, National Green Tribunal to give direction to the Union of India to restrict use of chemical pesticides, affecting health of the citizens and contaminating soil. Hon’ble NGT examined the issues with respected to the uncontrolled use of pesticide, insecticide in agricultural lands resulting soil pollution and water pollution. At length, Principal Bench, NGT observed that the Directorate of Plant Protection, Quarantine and Storage under the MoAFW mandated to  popularize adoption of integrated pest management (IPM) through promotion of biological control approaches in crop protection technology, ensuring availability of safer and effective pesticides through regulatory measures under the Insecticides Act, 1968 prevent introduction of exotic pests inimical to Indian agriculture by implementation of Destructive Insects and Pests Act, 1914 supported by Plant Quarantine Order (Regulation of Import into India), 2003. NGT also directed to Union of India, CPCB and respective SPCBs to evolve an appropriate protocol for this purpose and circulated it to the concerned agencies. Each affected farmer has legal right to file an application before NGT having competent jurisdiction to get appropriate compensation for loss of soil fertility of his agricultural land. Addressing on the issue Mr. Gautam Das,  prominent lawyer in Supreme Court said that of late the society realising the difficulty is raising voice on such good social cause. The food grains  available for the mankind produced through chemical and fertiliser and chemical process are cancerous to which the society cannot keep quite.“Amongst other prominent participants and active members of the organisation who made the program successful are the organising secretary of the legal Department Mr. Debasis Bhuyan, Mr. Bijay Ketan Sahu, Agriculture Scientist who has worked for several years in Phulbani popularising Organic farming.
