Themed &#8216;A World in Transition&#8217;, the&#13;<br \/>\nglobal legal conference will be held virtually from 6 to 10 September 2021. The Convention opened for signature on 7 August 2019 in&#13;<br \/>\nSingapore, with 46 signatories. To date, the Convention has 54&#13;<br \/>\nsignatories,\u00a0 and six Parties. It also reduces time and costs for parties as well as burdens to the&#13;<br \/>\nstate. Due to its conciliatory nature, it better facilitates business&#13;<br \/>\ncontinuity and relationships, also reducing instances where a dispute leads to&#13;<br \/>\ntermination of commercial relationships. Mediation is also a flexible solution&#13;<br \/>\nfor international disputes as it can be combined with or complement other modes&#13;<br \/>\nof dispute resolution, such as litigation or arbitration.<\/li>\n<\/ul>\n<ul>\n<li>However, its growth has been hindered by the&#13;<br \/>\nlong-standing obstacle of a lack of enforceability of the mediated settlement agreement.&#13;<br \/>\nUnlike a court judgment or an arbitral award, previously, a mediated agreement&#13;<br \/>\nwas only binding contractually and not directly enforceable. The lack of an&#13;<br \/>\nefficient and harmonised framework for cross-border enforcement of settlement&#13;<br \/>\nagreements resulting from mediation was often cited as a challenge in utilising&#13;<br \/>\nmediation as an effective solution.<\/li>\n<\/ul>\n<ul>\n<li>The Singapore Convention directly addresses the&#13;<br \/>\nlack of an effective means to enforce cross-border commercial mediated&#13;<br \/>\nsettlement agreements by providing the framework by which agreements may be&#13;<br \/>\nenforced. Businesses can have greater assurance that mediation can be relied on&#13;<br \/>\nto settle cross-border commercial disputes because mediated settlement&#13;<br \/>\nagreements can be enforced more readily by the courts of contracting parties to&#13;<br \/>\nthe Singapore Convention.<\/li>\n<\/ul>\n<ul>\n<li>This certainty of outcomes is beneficial for&#13;<br \/>\nbusinesses especially during a period of uncertainty such as the COVID-19&#13;<br \/>\npandemic. It will also help to promote the use of mediation around the world&#13;<br \/>\nfor cross-border disputes, saving time and costs, and potentially ensure better&#13;<br \/>\nbusiness continuity, facilitating the growth of international trade and&#13;<br \/>\ncommerce.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p><b><u>Applicability of the&#13;<br \/>\nSingapore Convention <\/u><\/b><u\/><\/p>\n<ul>\n<li>The Singapore Convention <b>will<\/b> apply to&#13;<br \/>\ninternational commercial settlement agreements resulting from mediation. The&#13;<br \/>\ncourts of a contracting party will be expected to handle applications either to&#13;<br \/>\nenforce an international settlement agreement that falls within its scope or to&#13;<br \/>\nallow a party to invoke the settlement agreement to prove that the matter has&#13;<br \/>\nalready been resolved, in accordance with its rules of procedure, and under the&#13;<br \/>\nconditions of the Singapore Convention.<\/li>\n<\/ul>\n<ul>\n<li>The Singapore Convention <b>will not <\/b>apply&#13;<br \/>\nto:<br \/>\u00b7\u00a0 International settlement agreements that are concluded in the course of judicial or arbitral proceedings and which are enforceable as a court judgment or arbitral award; or<br \/>\u00b7\u00a0 Settlement agreements concluded for personal, family, or household purposes by one of the parties (a consumer), as well as settlement agreements relating to family, inheritance, or employment law.<\/li>\n<\/ul>\n<ul>\n<li>The courts of a contracting party may refuse to&#13;<br \/>\ngrant relief on the grounds laid down in the Singapore Convention, including:<br \/>\u00b7\u00a0 If a party to the settlement agreement was under incapacity;<br \/>\u00b7\u00a0 If the settlement agreement is not binding, null and void, inoperative, or incapable of being performed under the law to which it is subjected to;<br \/>\u00b7\u00a0 If there was a serious breach by the conciliator of standards applicable to the conciliator, without which breach that party would not have entered into the settlement agreement;
